Prohibited and Restricted Jurisdictions, Companies, Governments, Persons, Products & Industries

Use of ShopWired Payments' services for any dealings, engagement, sale of goods, sale of services, or any other type of transaction linked directly or indirectly with any or all of the following is strictly prohibited:

1. Any entity linked directly or indirectly with the following jurisdictions
   • Cuba
   • Iran
   • North Korea
   • Syria
   • Russia
   • Crimea
   • The Donetsk Region within Ukraine
   • The Luhansk Region within Ukraine
2. Individuals, entities, or governments named on a restricted person or party list, including sanctions lists, of any or all of the following:
   • United States of America
   • United Kingdom
   • European Union
   • United Nations
3. To directly or indirectly export, re-export, sell, or supply physical goods or any kind of services to any person, company, entity, or any local or national government that resides within Russia.

Use of ShopWired Payments' services for any of the following activities is strictly prohibited:

• Any product or service that is illegal in the jurisdiction to which it is being sold, supplied from, or transitioning
• Fake references or ID-providing services
• Any equipment capable of interfering with or manipulating telecommunications
• Sale or distribution of any product (physical or digital) that infringes on the copyrights or intellectual property of a third party without proper authorisation such as, but not limited to, music, movies, software, counterfeit goods
• The unauthorised sale of brand name or designer products or services
• Any pyramid or 'get rich quick' scheme including, but not limited to, investment opportunities and cryptocurrency schemes
• Any product or service providing online website traffic or social media engagement
• Negative response marketing or telemarketing
• Any product or service that ShopWired Payments determines, as sole arbiter, to be unfair, deceptive, or predatory
• Pornography or other adult material that depicts nudity or sexually explicit acts
• Adult services including prostitution, escort services, sexual massage services, or any online pay-per-view or adult live chat
• Adult video stores
• Online dating services
• Any sale of firearms, explosives, or any other type of dangerous material
• Any games of chance, lottery, bidding fee auctions, gambling, sweepstakes, contests, fantasy sports leagues for any type of prize
• Any product containing cannabis or marijuana

Where ShopWired Payments has been used for any of the prohibited or restricted activities listed above and prior written approval from ShopWired Payments has not been received by the user for such activity, ShopWired Payments will at its sole discretion take one or more of the following actions against your account:

• Immediately and without notice suspend all payouts and cancel any payouts in transit
• Immediately and without notice suspend the ability to receive new payments from customers
• Require any additional information or verification from you that ShopWired Payments deems reasonably necessary
• Only release transacted funds to payout once six months have elapsed after the transaction was completed

You must not use ShopWired Payments in any way where you have provided us with any false, manipulated, inaccurate, or misleading information that pertains to your identity, business entity, the nature of your business, business location, or any other information that ShopWired Payments requests as part of the initial setup process of your account or any other information that it requests.

• You must not use ShopWired Payments to facilitate transactions on behalf of any third party
• You must not use ShopWired Payments to evade card network chargeback monitoring programmes
• You must not use ShopWired Payments to facilitate cross-border acquiring where the business address of the merchant is outside of the jurisdiction of the acquiring ShopWired Payments entity
• You must not share cardholder information with another merchant for payment of cross-sell products or services

Certain products and services may be provided by you and payment received through your ShopWired Payments payment facility only where you have received prior written approval from us for doing so.

If your business falls into one of the categories below you must contact us before using ShopWired Payments for any transactions that relate to them.

• Any financial service including investments, lending, buy now pay later, crowdfunding, debt collection, insurance, currency exchange, cryptocurrency, and NFTs
• CBD products
• Online pharmacies, prescription-only products, regulated medical devices, telemedicine, or telehealth services
• Tobacco products, including cigarettes, cigars, rolling tobacco, e-cigarettes, e-liquids
• Identity theft protection services
• Any product that is age-restricted, including alcohol
• Travel reservation services including accommodation services, air travel services, sea travel services, land travel services
• Prepaid phone cards, sim cards, and phone services
• In-game currency or game items
• Multi-level marketing
• Network marketing and referral marketing
• Shipping and forwarding brokers
• Drop shipping
• Charity sweepstakes and raffles
